This is an action brought by the appellee Lyman Munsell to recover damages from the appellant Ideal Food Stores arising out of an incident which occurred on November 12, 1968. Munsell recovered a judgment against Ideal in the total amount of $30,012.45 after trial by jury. Certain facts in this case are not in dispute.
