This is an appeal from a conviction for murder with malice. The jury assessed punishment at life.

Charles B. Ostrander, service writer for Taylor Pontiac in Dallas, testified that at about 8:30 a. m. on April 6, 1970, appellant approached him concerning repairs on appellant's automobile.
