Donald Anthony DeLuzio, hereinafter referred to as the "defendant," was convicted by a jury of the crime of conspiracy. Following the jury verdict, a motion for a new trial was made on the basis of newly discovered evidence. The motion was denied after an evidentiary hearing and sentence was then imposed.
