Appellant, Larry Joe Hopkins, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Tulsa County, Oklahoma, for the offense of Second Degree Burglary, After Former Conviction of a Felony; his punishment was fixed at twenty (20) years to sixty (60) years imprisonment, and from said judgment and sentence, an appeal has been perfected to this Court.
