MORRISON, Judge.

This is a post-conviction application for Writ of Habeas Corpus under Art. 11.07, Vernon's Ann.C.C.P. Petitioner's conviction was affirmed in Parker v. State, Tex. Cr.App., 457 S.W.2d 638.

For the purposes of this opinion, we note petitioner was committed to Rusk State Hospital in 1963 following a hearing to determine his competency (present sanity) to stand trial. In 1969 he was returned...
