McFADDEN, Justice.

On May 1, 1962, Richard Martin was employed by Robert W. Woods. He was married and the father of two minor children. On that date he sustained grievous multiple injuries in an industrial accident arising out of his employment.

Martin had been drawn into a winch in the lumber company's operation. He sustained the loss of his right eye, his right arm was badly broken and ultimately was rendered useless, two fingers of his right hand were lost...
