The origin of this appeal is a suit on open account brought by plaintiff, Ory J. Hooter d/b/a O. J. Hooter Furniture Company, against defendant, Richard Wilson, for payment due on merchandise purchased from plaintiff. Judgment in the amount of $305.77 was rendered on March 6, 1968, in First City Court for the City of New Orleans in favor of plaintiff and against defendant, an employee of the City of New Orleans.
