The appellant and another were charged with theft under an indictment which alleged that they knowingly, unlawfully and feloniously exerted unauthorized control over a portable television set belonging to another with the intent to permanently deprive the owner of the use of the set. The appellant was tried alone, and, having waived a jury trial, was found guilty in the Criminal Court of Marion County of theft in a sum less than $100.00 and sentenced...
