At the September 8, 1969 Session, Duplin Superior Court, the defendant, Roger Vernon Miller, was tried and convicted of the crime of murder in the first degree and sentenced to death. Upon defendant's appeal this Court found no error in the verdict and judgment of the Superior Court. State v. Miller, 276 N.C. 681, 174 S.E.2d 481.
