J. Henry Jones Co. (hereinafter called Jones), supplier, sued defendant Don Smith, contractor, for a balance due on supplies and equipment which the latter had purchased for use in installing a water-treatment plant at Blanding, Utah. Upon a trial to the court it found that plaintiff had delivered equipment and supplies for a total price of $40,969.00, all of which had been paid except $9,085.13.
