Carol English Shaw filed a complaint, in her individual capacity, alleging that her husband was killed instantly on December 28, 1967, near Murphy, North Carolina, when a servant and employee of the defendant negligently and recklessly drove a motor vehicle into another motor vehicle driven by the decedent.
