Petitioner, tenant in a rent controlled apartment, unilaterally replaced a new refrigerator supplied by the landlord. He thereafter sought a rent reduction based upon such unilateral replacement. The Commissioner found that the landlord was at all times ready and willing to restore the refrigerator but that he was prevented from doing so by the tenant. He further ruled that it would be inequitable to grant a decrease in rent under these circumstances, and denied the tenant...
