Plaintiff in error, Howard Lee Brown, hereinafter referred to as defendant Brown, was convicted of Possession of Marihuana along with co-defendants Robert Scott Reser and Eugene Raymond Osburn in the District Court of Tulsa County, Case No. CRF-69-1357.
