OPINION

MASSEY, Chief Justice.

This is a "rear end" collision case. Plaintiff Louva Jo Chapmond recovered a judgment against defendant John Calvin Patton and he appealed.

Affirmed.

On oral presentation the attorney for the defendant agreed that there was no question of his client's negligence, though there was contention that it was "excusable" under the theory that he was confronted with a situation of "sudden emergency". He contended, however...
