This is a post conviction proceeding under the provisions of sections 29-3001 to 29-3004, R.S.Supp.1969.

Defendant Huffman had been convicted by a jury in the district court for Hall County on four counts. Count I was for forgery of a $42 check. Count II was for uttering the same check.
