This appeal is from a judgment of the trial court dismissing an action for personal injuries brought by plaintiff, Percy Burfict, individually, and as the administrator of the estate of his minor daughter, Bernadette. The injuries incurred by the then 13 year old child resulted from an accident between the minor, a pedestrian, and a truck driven by Richard Jackson, an employee of Fred Trosclair, defendant and owner of the truck.
