Appeal from a judgment of the district court dismissing Michael Eliseuson's alleged cause of action upon the motion of defendants, James Frayseth and William Frayseth.

The pertinent facts are as follows: On August 27, 1958, defendant James Frayseth, then 15 years of age, accidentally shot plaintiff, then 14 years of age, with a.22-caliber pistol. James was at that time vacationing...
