ERWIN, Justice.

Travis O. Spaulding was convicted of assault with a dangerous weapon in connection with a shooting incident which occurred on the evening of May 4, 1969, in Fairbanks. When the events in question took place, Thomas Garrett had driven to a duplex owned by him and rented to Douglas Joslyn. When he entered Joslyn's apartment he found Travis Spaulding inside.
