Order reversed, plaintiff's motion granted and judgment vacated. Plaintiff shall serve a complaint upon defendants Quinn within 20 days after service of copy of the order to be made hereon with notice of entry. Appeal from judgment dismissed as academic. Defendants Quinn are awarded $10 costs and disbursements against plaintiff to cover both appeals.

Plaintiff's decedent was fatally injured while riding as a passenger in the automobile of the Quinn defendants' decedent...
