HARRISON, Justice.

Richard W. Bagley filed his motion for judgment against Willie C. Bagley, defendant, to recover damages for personal injuries sustained in an automobile accident allegedly caused by the gross negligence of defendant.

Subsequently Richard W. Bagley died of natural causes unrelated to the accident, and this action was revived in the name of William Beverly Weaver, his administrator. We refer to the parties as plaintiff and defendant, the positions...
