Plaintiff has moved for summary judgment in an action brought against the defendant seeking a determination that his recent amendment of 18 NYCRR 369.1 is illegal, and therefore void. It is stipulated by both parties that there are no issues of fact involved, and that the court has jurisdiction to determine this matter.
