SWANSON, J.

If one injured in an automobile by a negligent driver obtains a judgment for damages against that driver and subsequently against the driver's insurance company, but that insurance company becomes insolvent and fails to pay, is the negligent driver an "uninsured motorist" so that the one injured may be compensated by his own insurance company? That is the primary question raised on this appeal, and we answer it in the affirmative.
