On September 6, 1966, respondent obtained a building permit from the Superintendent of Buildings of the Town of Colonie for renovations to premises she had leased. The application stated that the premises were intended to be used "for western shows and restaurant". The zoning ordinance of the town did not permit the conduct of a restaurant on the premises in question.
