This is an appeal from the Marion County Circuit Court. The City of Indianapolis by and through its Board of Sanitary Commissioners had filed a petition in the Circuit Court of Marion County pursuant to IC 1971, 19-2-16-12 (formerly Acts 1931, Ch. 117, s. 12; Burns § 48-4012).
