This day came again the parties, by counsel, and the court having maturely considered the transcript of the record of the decree aforesaid and arguments of counsel, and being equally divided as to the judgment to be entered in the premises, it is ordered that the said decree be affirmed, and that the appellants pay to the appellees thirty dollars damages, and also their costs by them expended about their defense herein.
