No. 71-82.

255 So.2d 546 (1971)

Joseph M. MAURICI-LINO, Etc., Appellant, v. Virgil BROOKS et al., Appellees.

District Court of Appeal of Florida, Second District.

December 22, 1971.

Attorney(s) appearing for the Case

Boyt L. Elam, of Barrs, Melendi & Williamson, Tampa, for appellant.

Benjamin H. Hill, III, of Shackleford, Farrior, Stallings & Evans, P.A., Tampa, for appellees.

PER CURIAM.

Appellant, plaintiff below, takes this appeal from a final summary judgment entered in favor of appellees.

Upon careful examination of the record on appeal it appears that there are genuine issues of material facts which preclude the entry of a summary judgment.

Reversed and remanded.
