Appellant (plaintiff) The Home Insurance Company brought suit to set aside an order of the Industrial Accident Board which awarded death benefits under the Texas Workmen's Compensation Act. The suit was brought against Inez Burkhalter, individually and as the surviving widow of Vernon Webster Burkhalter, and as next friend for Judith Ann Burkhalter, the surviving minor child of the deceased.
