The appellee Theodore R. Awbrey filed an action for damages for personal injuries against the appellant Southern Bell Telephone & Telegraph Company, alleging his injuries proximately resulted from negligence of the defendant. The latter answered, denying negligence and pleading contributory negligence and assumption of risk. Trial before a jury resulted in a verdict in favor of the plaintiff. Judgment was entered thereon.
