OPINION

COBEY, J.

Ezell Millard appeals from a judgment (order granting probation) following his being found guilty of possession of marijuana after a trial to the court. The primary basis for the appeal is appellant's contention that the marijuana introduced into evidence against him was obtained by the police by means of an unconstitutional search and seizure.
