FITZGERALD, J.

Third-party defendant City of Detroit appeals as of right from a judgment rendered against it in a contract action for the amount of $37,497. Said judgment was in favor of defendant Martin Tropf & Sons, Inc.

Plaintiff Fulco, Inc., a subcontractor, sued defendant Tropf for moneys due it on a contract for work, labor, materials, and design. Third-party defendant Detroit was brought in on a motion by defendant Tropf.
