This cause arises out of a certain contract, as follows, to-wit:

"THIS AGREEMENT, made in the city of Kendallville, Indiana State of Indiana, this 1 day of July, 1967; between Howard Clark (hereinafter referred to as Company) and Ron Linnie [sic], dba/Melody Bar (hereinafter referred to as Proprietor), WITNESSETH: "In consideration of the mutual covenants and agreements herein contained, the parties agree as follows:
