FITZGERALD, P.J.

Defendant Richard Berles was convicted of involuntary manslaughter, a violation of MCLA § 750.321 (Stat Ann 1954 Rev § 28.553), on November 13, 1969, following a seven-day jury trial. On January 16, 1970, he was sentenced to serve 3 to 15 years in the state prison at Jackson. Defendant now appeals as a matter of right.
