Facts.

The plaintiff in error, Robert A. Bohachef, hereinafter termed defendant, was charged with burglary, contrary to sec. 943.10 (1) (a), Stats.

On April 14, 1970, an apartment shared by Thomas Butenhoff and a roommate, located at 2986 North Oakland Avenue in the city of Milwaukee, was broken into and four items of stereo equipment, including a headset, were taken.
