PER CURIAM.

The defendant is charged with resisting arrest. MCLA § 750.479 (Stat Ann 1954 Rev § 28.747). Pursuant to MCLA §§ 767.77, 767.78 (Stat Ann 1954 Rev §§ 28.1017, 28.1018), the defendant moved for appointment of a commission to examine two witnesses who presently reside in California. The motion was denied and the defendant has appealed on leave granted. We affirm.
