The six defendants have been charged with violations of the Pennsylvania Bituminous Coal Mine Act of July 17, 1961, P. L. 659, 52 PS §701-101, et seq., in connection with an accident which occurred at the Montour No. 4 Mine of the Pittsburgh Coal Company.

Although the accident resulted in the death of a miner, it is not charged that the acts of defendants which constituted the alleged violations were the cause of the death...
