Ahrens, Jr., the owner of lands in sections 30, 31 and 32, T. 6 N., R. 12 W., brought this action against appellees Monnie Ruth Harris and Jim and Peggy Harris, husband and wife, to lay off a private road pursuant to Ark.Stat.Ann. § 76-110 (Repl.1957), across a seven acre tract owned by Jim Harris, subject to the homestead and dower rights of his mother.
