MEMORANDUM

WEBSTER, District Judge.

This is an action for recovery of individual federal income taxes alleged to have been erroneously assessed and collected. Jurisdiction of the court is based on 28 U.S.C. § 1346(a) (1).

G. A. and Kathryn Buder, plaintiffs herein, timely filed a joint individual income tax return for the year 1965. Included within income reported by plaintiffs in this return was the sum of $26,072.75 representing dividends...
