On August 10, 1970, plaintiffs commenced this suit to recover judgment against defendant in the sum of $33,995.91, and alleged:

         "2. Defendant owes plaintiffs Thirty-three Thousand, Nine
        Hundred Ninety-five and 91/100 Dollars ($33,995.91) for money
        lent by plaintiffs' legator, David A. Burkett, to defendant on the
        following dates:
