MOYLAN, J., delivered the opinion of the Court.

The appellant, George Roberts, at that time a twelve year old, 7th grade student at the Pimlico Junior High School, was charged on the petition of Joseph E. Maddox, the Security Officer at that school, with being a delinquent child in that on April 7, 1970, he "assaulted and beat by jumping on his back, knocking him to the ground, and choking him, David Horowitz." Significantly, the petition was not filed until November...
