LANDIS, Judge.

This application for review is the sequence of a second round of trial proceedings1 as a result of the reversal and remand by the Supreme Court of the United States2 of the Court of Customs and Patent Appeals3 which previously had reversed the appellate term of this court,4 which theretofore had affirmed the trial court.
