The principal action was an action of tort by the plaintiff O'Mara for injury due to the negligent driving of the defendant Zwicker, an employee of the defendant H.P. Hood & Sons, Inc. (Hood). At the time of the accident the plaintiff was a passenger in a car driven by Ann Bodmer, and Hood and Zwicker impleaded Bodmer as a third party defendant, claiming contribution under G.L.c. 231B, § 1, inserted by St. 1962, c. 730, § 1.
