Defendant was indicted for robbery (not while armed), in violation of N.J.S.A. 2A:141-1. He was charged with having taken $256.67 from the person of Robert Shields. When the jury completed its deliberations, the court clerk erroneously asked them "What is your verdict as to armed robbery?" The foreman responded by saying, "Guilty as charged." No objection was made to the verdict as returned. However...
