OPINION

POWERS, Justice.

These are appeals from the entry of two judgments in the Superior Court in a civil action the background of which requires a somewhat extended delineation.

In furtherance of its constitutional duty to promote public schools, the General Assembly enacted P.L. 1958, chap. 55, approved May 14, 1958. Section 1 of said Act provides as follows:

"There shall be held in each of the towns of Charlestown, Richmond and Hopkinton...
