In a trial commencing August 4, and completed August 18, 1970, defendant Douglas Rogers, jointly tried with one Mitchell Dunn, was convicted by court verdict of murder in the first degree while in the perpetration of an armed robbery contrary to MCLA § 750.316 (Stat Ann 1954 Rev § 28.548).
