OPINION

ROBERTS, Chief Justice.

This petition for certiorari was brought to review the action of a justice of the Family Court in denying the respondent's motion to vacate an interlocutory decree of divorce entered on February 18, 1970. The respondent has also prosecuted an appeal to this court from that decision, and the appeal has been consolidated with the petition for certiorari for hearing.
