Defendant, after trial by jury, was convicted of murder in the first degree but without death penalty. He appeals. The agreed statement of facts may be briefly summarized.

Jeffery Huggard, a 16-year-old Glacier High School student, was last seen alive on December 1, 1968. That evening he had been the sole attendant of a south Seattle service station. When Jeffery failed to return home his parents went to the station and found it open and unattended...
