Defendant was arrested and charged with first-degree murder. Following a seven-day jury trial in Macomb County Circuit Court, defendant was found guilty of murder in the second degree. MCLA § 750.317 (Stat Ann 1954 Rev § 28.549). Defendant appeals as a matter of right.
