Defendant was convicted by a jury of second-degree murder. MCLA § 750.317 (Stat Ann 1954 Rev § 28.549). In addition to second-degree murder the jury was instructed on murder in the first degree (MCLA § 750.316 [Stat Ann 1954 Rev § 28.548]) and manslaughter (MCLA § 750.321 [Stat Ann 1954 Rev § 28.553]).
