HOLBROOK, J.

On April 16, 1968, in the Recorder's Court for the City of Detroit, defendant was found guilty of second-degree murder (MCLA § 750.317 [Stat Ann 1954 Rev § 28.549]) by a jury. Defendant was sentenced to a term of 12-1/2 to 20 years. A motion for new trial was denied and defendant appeals.

On January 31, 1967, at about 4 p.m., one Patricia Jean Rushing was killed, allegedly by the defendant, at their residence in Detroit. Death was caused...
