Appellant Edward Garrett Hoskins appeals from a denial of habeas corpus relief by the district court. We remand for further proceedings.

On May 21, 1959, the appellant was charged by indictment in the Circuit Court of Leon County, Florida, with the commission of an attempted robbery in that county on February 4, 1959.
